TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
By accessing or using the services provided by Home Fund ("Company," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.
These Terms constitute a legally binding agreement between you and Home Fund. Your continued use of our services following any modifications to these Terms constitutes acceptance of those modifications.
2. SERVICE DESCRIPTION
Home Fund provides educational and strategic guidance services related to home financing, including but not limited to:
A. Mortgage Option Education: Information and educational resources regarding various mortgage products, loan types, interest rate structures, and financing alternatives available in the residential real estate market.
B. Down Payment and Funding Strategy: Guidance on developing strategies for accumulating down payment funds, understanding down payment requirements, and exploring various funding sources and approaches.
C. Investor Financing Guidance: Educational services and strategic advice for real estate investors regarding financing options, investment property loan requirements, portfolio building strategies, and funding structures.
Our services are strictly educational and advisory in nature. Home Fund does not originate loans, provide mortgage brokerage services, offer legal advice, or provide tax advice. We do not guarantee loan approval, specific interest rates, or particular financing outcomes. We are not a licensed mortgage lender or broker, and we do not act as a real estate agent or financial advisor unless separately licensed and disclosed.
3. USER OBLIGATIONS
By using Home Fund services, you agree to:
A. Provide accurate, complete, and current information as requested during consultations and service delivery.
B. Maintain the confidentiality of any account credentials or access information provided to you.
C. Use the services only for lawful purposes and in accordance with these Terms.
D. Refrain from misrepresenting your financial situation, investment objectives, or any other material information.
E. Acknowledge that you are responsible for independently verifying any information provided and conducting your own due diligence before making financial decisions.
F. Comply with all applicable federal, state, and local laws and regulations related to real estate transactions and financing.
G. Not reproduce, distribute, modify, or create derivative works from any proprietary materials provided by Home Fund without express written permission.
H. Refrain from using our services to engage in any fraudulent, abusive, or harmful activities.
4. APPOINTMENT SCHEDULING AND CANCELLATIONS
A. Scheduling: Appointments may be scheduled through our designated scheduling system, by email, or by phone. All appointments are subject to availability and confirmation by Home Fund.
B. Cancellations by Client: Clients must provide at least 24 hours advance notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours notice may result in forfeiture of any session fees paid or may be charged a cancellation fee as specified in your service agreement.
C. No-Show Policy: Failure to attend a scheduled appointment without prior notice constitutes a no-show and may result in forfeiture of the full session fee. Repeated no-shows may result in termination of services.
D. Cancellations by Home Fund: We reserve the right to cancel or reschedule appointments due to emergencies, illness, or other circumstances beyond our control. In such cases, we will make reasonable efforts to provide advance notice and reschedule at your convenience. No fees will be charged for appointments cancelled by Home Fund.
E. Late Arrivals: If you arrive late to an appointment, the session may end at the originally scheduled time, and you may be charged the full session fee.
5. PAYMENT TERMS
A. Fees: All applicable fees for services will be communicated to you prior to service delivery. Fees may vary based on service type, consultation length, and scope of guidance required.
B. Payment Methods: Payment may be made by credit card, debit card, electronic transfer, or other methods as specified by Home Fund.
C. Payment Timing: Unless otherwise agreed in writing, payment is due at the time of service or as specified in any service agreement or invoice.
D. Non-Payment: Failure to pay fees when due may result in suspension or termination of services. Home Fund reserves the right to pursue collection of outstanding fees, and you agree to reimburse Home Fund for any costs incurred in collecting unpaid amounts, including reasonable attorney fees.
E. Refund Policy: All fees are non-refundable except as specifically stated in a separate service agreement or as required by applicable law. Refund requests must be submitted in writing to Audrey.Reed@homefund.info.
F. Price Changes: Home Fund reserves the right to modify service fees at any time. Changes will not affect services already purchased or contracted prior to the price change.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
A. Home Fund, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, arising out of or related to your use of our services.
B. Our total aggregate liability for any claims arising out of or related to these Terms or our services shall not exceed the total amount paid by you to Home Fund in the six months preceding the event giving rise to the liability.
C. Home Fund shall not be liable for any financial losses, loan denials, unfavorable loan terms, real estate transaction failures, investment losses, or any other damages resulting from your reliance on information or guidance provided through our services.
D. We are not responsible for the actions, errors, or omissions of any third-party lenders, real estate agents, financial institutions, or other service providers you may engage based on information obtained through Home Fund.
E. You acknowledge that real estate and financing markets are subject to numerous variables beyond our control, and past performance or typical outcomes do not guarantee future results.
F. Home Fund shall not be liable for any service interruptions, delays, or failures caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, telecommunications failures, or governmental actions.
7. WARRANTY DISCLAIMERS
HOME FUND PROVIDES ALL SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
A. Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
B. That our services will meet your specific requirements or achieve particular financial outcomes.
C. That our services will be uninterrupted, timely, secure, or error-free.
D. That any information provided is complete, accurate, or current, as financial markets and lending regulations are subject to constant change.
E. That any particular financing strategy will be suitable, available, or successful for your specific circumstances.
F. That you will qualify for any particular loan product, interest rate, or loan amount.
You acknowledge that:
A. Home financing and real estate investment involve significant financial risk and are subject to market fluctuations, regulatory changes, and economic conditions beyond our control.
B. All financial decisions made based on information or guidance provided by Home Fund are made at your sole discretion and risk.
C. You should consult with licensed professionals, including mortgage lenders, attorneys, tax advisors, and financial planners, before making any financial commitments.
D. Information provided during consultations reflects current knowledge and market conditions, which may change rapidly.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Home Fund, its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney fees) arising from:
A. Your use or misuse of our services.
B. Your violation of these Terms.
C. Your violation of any rights of another party.
D. Any misrepresentation of information provided to Home Fund or third parties.
E. Any financial decisions or transactions you undertake based on information obtained through our services.
9. INTELLECTUAL PROPERTY
A. All content, materials, tools, templates, presentations, and resources provided by Home Fund, including text, graphics, logos, images, and software, are the property of Home Fund or its licensors and are protected by copyright, trademark, and other intellectual property laws.
B. You are granted a limited, non-exclusive, non-transferable license to access and use materials provided to you solely for your personal use in connection with the services you have purchased.
C. You may not reproduce, distribute, modify, display, perform, publish, license, create derivative works from, or sell any content or materials obtained through Home Fund without express written permission.
10. CONFIDENTIALITY AND PRIVACY
A. Home Fund respects your privacy and will handle your personal and financial information in accordance with applicable privacy laws and regulations.
B. Information you provide during consultations will be kept confidential and will not be shared with third parties except as necessary to provide services, as required by law, or with your express consent.
C. You acknowledge that email and electronic communications may not be secure, and you assume the risk of communicating sensitive information through such channels.
D. Home Fund may use aggregated, anonymized data for business purposes, including improving services and conducting market research.
11. TERMINATION
A. Either party may terminate the service relationship at any time with written notice to the other party.
B. Home Fund reserves the right to immediately terminate or suspend your access to services if you breach these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.
C. Upon termination, you remain obligated to pay any outstanding fees for services already rendered.
D. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to limitations of liability, warranty disclaimers, and indemnification obligations.
12. NO PROFESSIONAL RELATIONSHIP
Unless separately disclosed in writing, the services provided by Home Fund do not create:
A. An attorney-client relationship. Our services do not constitute legal advice.
B. A fiduciary relationship. We do not act as your fiduciary unless separately agreed in writing.
C. A licensed financial advisory relationship. Our guidance is educational in nature.
D. A mortgage broker or lender relationship. We do not originate, broker, or guarantee loans.
You are encouraged to seek appropriate professional advice from licensed attorneys, certified financial planners, certified public accountants, and licensed mortgage professionals before making financial decisions.
13. THIRD-PARTY LINKS AND REFERRALS
A. Home Fund may provide links to third-party websites or referrals to other service providers for your convenience.
B. We do not endorse, control, or assume responsibility for the content, services, privacy policies, or practices of any third-party websites or service providers.
C. Any dealings you have with third parties are solely between you and such third parties, and Home Fund shall not be responsible for any losses or damages incurred.
14. GOVERNING LAW AND DISPUTE RESOLUTION
A. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Home Fund operates, without regard to conflict of law provisions.
B. Any disputes arising out of or related to these Terms or our services shall first be attempted to be resolved through good faith negotiation.
C. If negotiation is unsuccessful, disputes may be resolved through mediation or arbitration as mutually agreed, or through litigation in the appropriate courts having jurisdiction.
D. You agree that any legal action must be commenced within one year after the claim or cause of action arises, or such claim shall be permanently barred.
15. SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
16. ENTIRE AGREEMENT
These Terms, together with any separate service agreements or written addenda, constitute the entire agreement between you and Home Fund regarding the services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
17. WAIVER
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure by Home Fund to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
18. ASSIGNMENT
You may not assign or transfer these Terms or any rights granted hereunder without the prior written consent of Home Fund. Home Fund may assign these Terms or delegate any responsibilities hereunder without restriction.
19. ELECTRONIC COMMUNICATIONS
By using our services, you consent to receiving electronic communications from Home Fund. These communications may include notices, agreements, disclosures, or other information concerning our services. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
20. CHANGES TO TERMS
Home Fund reserves the right to modify, update, or replace these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to our website or notification to you by email or other means.
